Crdforum Escrow Terms of Service (TOS)

I. Introduction

These Rules and Regulations ("Agreement") govern the use of the Crdforum Escrow Service ("Service") provided by the Carding Forum ("Forum") and shall be binding upon any and all Users ("Users," "User," "You," or "Your") of the Service. By using the Service, You agree to be bound by the terms and conditions contained herein.

II. Definitions

1. "Bitcoin" or "BTC" refers to the digital or virtual currency utilized by the Service as a medium of exchange.
2. "Escrow" refers to the process where a trusted third party holds funds, in this case, Bitcoin, on behalf of the transacting parties until specific conditions are met.
3. "Products and Services" refers to any items or services offered by Users for sale or trade on the Forum.
4. "Transaction" refers to the process of exchanging Products and Services between Users in return for Bitcoin, using the Service as an intermediary.

III. Eligibility

1. Users must be registered members of the Forum.
2. Users must have a valid and active account on the Forum to use the Service.
3. Users are responsible for ensuring compliance with all applicable laws, regulations, and rules in their jurisdiction while using the Service.

IV. Service Use

1. Users agree to use the Service solely to facilitate Transactions involving the exchange of Bitcoin for Products and Services within the Forum.
2. Users shall not use the Service for any fraudulent, illegal, or prohibited activity.
3. Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
4. The Forum reserves the right to terminate, suspend, or restrict User access to the Service at any time, without prior notice or liability, for any reason or no reason, including but not limited to violation of this Agreement.
5. Our forum strictly adheres to a zero-tolerance policy against pornography. Any pornographic content uploaded to this platform will be promptly removed, and the user responsible will face a ban. It is important to note that uploading any underage photos will result in an immediate report to the authorities.

V. Transaction Process

1. The Buyer and Seller (collectively, the "Parties") shall agree on the terms and conditions of the Transaction, including the price, description of the Products and Services, and any other relevant details.
2. The Buyer shall deposit the agreed-upon amount of Bitcoin into the designated escrow wallet address provided by the Service.
3. The Service shall hold the deposited Bitcoin until the completion of the Transaction, subject to the terms and conditions of this Agreement.
4. Upon receipt of the deposited Bitcoin, the Seller shall deliver the Products and Services to the Buyer according to the agreed-upon terms.
5. The Buyer shall notify the Seller and the Service of the successful delivery of the Products and Services, or of any disputes, within a specified time frame.
6. If the Transaction is successful, the Service shall release the Bitcoin to the Seller, minus any applicable fees. If a dispute arises, the Service shall mediate the resolution of the dispute in accordance with this Agreement and the Parties' agreed-upon terms.

VI. Dispute Resolution

1. In the event of a dispute, the Parties shall first attempt to resolve the matter amicably through negotiation and communication.
2. If the Parties cannot reach an agreement, they may request the intervention of the Service as a mediator.
3. The Service shall evaluate the dispute based on the information provided by the Parties and shall determine in its sole discretion.
4. The Service's decision shall be final and binding on the Parties, and they agree to abide by it.
5. The Parties acknowledge and agree that the Service's decision may result in the release of the Bitcoin to either the Buyer or the Seller or the return of the Bitcoin to the Buyer.
6. The Parties also agree to cooperate fully with the Service in the resolution of any dispute and to provide any information or documentation requested by the Service.

VII. Fees

1. The Service shall charge a fee for each Transaction, as determined by the Forum and subject to change at any time.
2. The Parties shall be responsible for any additional fees associated with the use of the Bitcoin network, including but not limited to transaction fees and mining fees.

VIII. Disclaimer of Warranties and Limitation of Liability

1. The Service is provided on an "as is" and "as available" basis.
2. The Forum makes no representations or warranties of any kind, express or implied, as to the Service's operation or availability, or the information, content, materials, or Products and Services made available through the Service.
3. The Forum shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if the Forum has been advised of the possibility of such damages.

IX. Indemnification

1. Users agree to indemnify, defend, and hold the Forum, its affiliates, officers, directors, employees, agents, and representatives harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with their use of the Service, including but not limited to any breach of this Agreement.

X. Termination

1. The Forum may terminate or suspend the Service, or a User's access to the Service, at any time without notice or liability, for any reason or no reason, including but not limited to violation of this Agreement.
2. Upon termination, all rights and licenses granted to Users under this Agreement shall immediately terminate, and Users shall immediately cease all use of the Service.

XI. Entire Agreement

1. This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral, relating to the subject matter hereof.

XII. Amendments

1. The Forum may amend this Agreement at any time, without notice, by posting the amended terms on the Forum. Users are responsible for reviewing the amended terms regularly, and continued use of the Service following any such amendments shall constitute their acceptance of the amended terms.
